Security researchers who discover software vulnerabilities face a paradox: reporting a flaw to its vendor is supposed to make the internet safer, but that same act can expose the researcher to lawsuits, cease-and-desist letters, and even federal criminal charges. The Laws Most Commonly Weaponized
The Computer Fraud and Abuse Act (CFAA)
The CFAA was enacted in 1986, partially in response to congressional anxiety triggered by the 1983 film WarGames, in which a teenager accidentally nearly starts nuclear war by hacking a military supercomputer.2 The law criminalizes accessing a computer “without authorization or exceeding authorized access” — language so broad it has been interpreted to cover everything from password sharing to security research on public-facing systems.
The CFAA’s maximum penalties are severe: depending on the charge, a conviction can carry up to 10 years in prison per count. The law has been amended repeatedly — in 1989, 1994, 1996, 2001, 2002, and 2008 — each time expanding its reach.3
DMCA Section 1201
The Digital Millennium Copyright Act of 1998 added another legal weapon. Section 1201 criminalizes circumventing “technological protection measures” — in other words, bypassing DRM or access controls — even when the purpose is not copyright infringement but security research. Signed into law by President Clinton on October 28, 1998, the DMCA does contain a security research exemption, but its scope is narrow and contested.4

Landmark Cases That Defined the Problem
MBTA v. Anderson (2008): Silencing DEF CON
In August 2008, three MIT students — Zack Anderson, Russell Ryan, and Alessandro Chiesa — prepared to present their research at DEF CON, the world’s largest hacker conference, exposing critical vulnerabilities in the Massachusetts Bay Transportation Authority’s CharlieCard subway fare system. They had identified four fundamental flaws: fare values were stored on the card itself rather than in a secure database, card data could be easily read and overwritten, there was no cryptographic signature to prevent forgeries, and no centralized verification system existed.5
The MBTA filed suit and obtained a temporary restraining order (TRO) on August 9, 2008, blocking the students from presenting or discussing their findings. The order invoked the CFAA and effectively muzzled three students who had done everything the security community asks researchers to do — document the problem, prepare a responsible disclosure, and give the vendor time to respond.
The restraining order backfired spectacularly. The court inadvertently published the students’ presentation slides as court exhibits, making the information even more widely available through what’s now called the Streisand effect.5 On August 19, 2008, Judge George O’Toole rejected the MBTA’s request to extend the TRO. The students were eventually free to publish — but the lesson was clear: compliant researchers could be silenced with a legal filing and $50,000 in attorney fees.
Aaron Swartz (2011–2013): The Cost of Prosecution
Aaron Swartz was a programmer and internet activist who co-developed the RSS web feed format, contributed to Creative Commons, and co-founded Reddit. In January 2011, he was arrested after downloading academic journal articles from JSTOR using a guest account issued to him by MIT.6
Federal prosecutors charged Swartz with two counts of wire fraud and eleven violations of the CFAA, carrying a cumulative maximum penalty of $1 million in fines and 35 years in prison.6 Swartz declined a plea deal that would have resulted in six months in federal prison. On January 11, 2013, he was found dead in his Brooklyn apartment. He was 26 years old.
The Swartz case catalyzed lasting change in how the legal community views CFAA prosecutions. It demonstrated that prosecutors could use the law’s vague “unauthorized access” language to turn technical activity — accessing a computer system — into a federal felony carrying penalties wildly disproportionate to any plausible harm.
NXP vs. Radboud University (2008): A Different Outcome Abroad
Not all legal threats against researchers succeed — and not all fail to succeed everywhere. The cases that reach court headlines represent a fraction of the actual suppression. For every MBTA lawsuit there are dozens of cease-and-desist letters that never become public. Researchers who receive those letters typically have three options: hire a lawyer, go silent, or publish and risk everything.
The economic calculus is stark. A company can dispatch a legal threat for the cost of a lawyer’s hourly rate. Defending against that threat can cost a researcher tens of thousands of dollars. The result: legitimate research dies in private.

What Has Changed (and What Hasn’t)
Van Buren v. United States (2021): A Narrow Win
The most significant legal development for security researchers in recent years came from the U.S. Supreme Court. In Van Buren v. United States (593 U.S. 374), decided June 3, 2021, the Court ruled 6–3 that a person “exceeds authorized access” under the CFAA only when they access files or areas of a computer they are not permitted to access — not simply when they access authorized systems for unauthorized purposes.11
The ruling narrowed the CFAA’s reach. It means a security researcher who accesses a publicly reachable endpoint is less likely to be prosecuted for “exceeding authorized access” simply because the company would prefer they hadn’t. But the decision did not create a safe harbor for security research. The ambiguity around “without authorization” remains legally live.
The DOJ’s 2022 Policy Statement
In May 2022, the U.S. Department of Justice announced a new charging policy stating that it would not bring CFAA charges against researchers acting in good faith to identify and report security vulnerabilities. The policy instructed federal prosecutors to weigh whether the defendant’s conduct was “genuinely for purposes of good-faith security research.”
This is a policy, not a law. A new administration or a single U.S. Attorney can ignore it. It also offers no protection against private civil lawsuits — and companies, not the DOJ, have filed most of the legal threats researchers actually face.
Bug Bounty Programs: Structured Safe Harbor
The most reliable protection for researchers today is operating within a formal bug bounty program. These programs, pioneered by Netscape in 1995 for the Navigator 2.0 beta, grant explicit authorization to find and report vulnerabilities in exchange for recognition and often financial reward.12 As of early 2026, major programs are operated by Microsoft, Google, Facebook, the European Union, and the U.S. federal government, with platforms like HackerOne and Bugcrowd serving as intermediaries.
Researchers who find vulnerabilities outside a bug bounty scope — in systems that haven’t set up any disclosure program — remain in the same legal gray zone that caught Aaron Swartz and the MIT students.

The companies filing these threats often claim they are protecting their intellectual property or preventing harm. But the actual effect is the opposite: by suppressing research, they suppress the public’s ability to assess risk.
